Thank you for considering our mobile application (the “App”). Before you use the App, please read these Terms and Conditions (“Terms”) carefully. These Terms govern your use of the App and constitute a binding agreement between you and our company.

License and Ownership

  • Interfere with the operation of the App or any other user’s enjoyment of the App;

  • Reverse engineer or attempt to extract the source code of the App;
  • Use the App for any commercial purpose or for the benefit of any third party; or
  • Use the App to transmit or store any harmful or malicious code or software.

User Content

The App may allow you to upload, submit, or transmit content, including photos, text, and other materials (“User Content”). You retain all rights in your User Content, but by uploading, submitting, or transmitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable right to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit your User Content for any purpose, including for the promotion of the App.

You represent and warrant that your User Content does not infringe any third-party rights, including intellectual property rights, and that you have all necessary rights to upload, submit, or transmit your User Content to the App.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE APP WILL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE APP.

Indemnification

You agree to indemnify and hold us harmless from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App or any User Content you upload, submit, or transmit to the App.

Termination

We may terminate your access to the App at any time for any reason. These Terms will survive any such termination.

Governing Law and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of Romania. Any dispute arising out of or related to these Terms or the App will be brought exclusively in the courts located in [insert jurisdiction], and you consent to the jurisdiction of such courts.

Changes to the Terms

We reserve the right to modify these Terms at any time in our sole discretion. Any changes will be effective immediately upon posting the revised Terms on the App. Your continued use of the App after the posting of the revised Terms constitutes your agreement to the revised Terms.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings, whether written or oral. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
